We are the data controller for personal information collected through this website.

This Privacy Policy explains what personal data we collect, how we use it, how we protect it, and your rights under Kenya's Data Protection Act, 2019 (DPA 2019).

2. Data We Collect

Contact form submissions

When you submit an enquiry through our website contact form, we collect:

  • Full name
  • Email address
  • Service of interest
  • Your message or project description

Nova chatbot conversations

Our AI assistant Nova may collect the same categories of information (name, email, service interest, message) when you choose to share them during a conversation. This data is only collected when you voluntarily provide it to receive a follow-up from our team.

Technical data

Like all websites, our server and hosting infrastructure may log standard technical information such as your IP address, browser type, referring URL, and pages visited. This data is used solely for security monitoring and performance diagnostics and is not linked to your personal identity.

Advertising and analytics pixels

We may in the future deploy third-party tracking technologies including the Meta Pixel (Facebook/Instagram Ads) and Google Ads conversion tracking. When active, these tools may collect data about your interactions with our website and share it with Meta Platforms Inc. and Google LLC for the purpose of measuring ad performance and enabling retargeting. This policy will be updated prior to any such tools becoming active. Currently, no advertising pixels are deployed on this website.

3. How We Use Your Data

We use the personal information you provide exclusively to:

  • Respond to your enquiry or project request
  • Contact you to discuss your requirements and provide a proposal
  • Follow up on previous correspondence at your request
  • Improve the quality of our services based on aggregated, non-identifiable feedback

We do not sell, rent, or trade your personal data to third parties. We do not use your contact details for unsolicited marketing communications without your explicit consent.

4. Legal Basis for Processing

Under the Kenya Data Protection Act, 2019, we process your personal data on the following lawful grounds:

  • Consent — by submitting a contact form or engaging with Nova, you consent to us processing your data to respond to your enquiry.
  • Legitimate interests — we have a legitimate interest in maintaining records of client communications for the purpose of service delivery.
  • Contractual necessity — where we have entered or are entering into a contract with you, processing your data is necessary to fulfil that contract.

5. Where Your Data Is Stored

Enquiry data submitted through this website is stored in Supabase, a cloud database platform. Supabase infrastructure is hosted on Amazon Web Services (AWS) and data may be stored in data centres located outside Kenya, including in the European Union or the United States.

Where data is transferred outside Kenya, Datapyre Technologies takes reasonable steps to ensure it receives equivalent protection in line with the requirements of the DPA 2019 and its regulations.

Access to stored enquiry data is restricted to authorised Datapyre Technologies personnel only, through a password-protected internal admin panel.

6. Cookies

This website does not currently place any first-party cookies on your device. We do load fonts from Google Fonts (fonts.googleapis.com), which is served via Google's CDN. Google may collect limited technical data in connection with this request in accordance with Google's own Privacy Policy.

If advertising pixels or analytics tools are added in future, a cookie consent mechanism will be implemented at that time and this section updated accordingly.

7. Data Retention

We retain contact enquiry data for a maximum of 24 months from the date of submission, or until the purpose for which it was collected has been fulfilled, whichever is sooner. You may request deletion of your data at any time (see Section 8 below) and we will act on that request within 30 days.

8. Your Rights

Under the Kenya Data Protection Act, 2019, you have the right to:

  • Access — request a copy of the personal data we hold about you
  • Rectification — request correction of inaccurate or incomplete data
  • Erasure — request deletion of your personal data
  • Restriction — request that we limit how we process your data
  • Objection — object to our processing of your data on grounds of legitimate interest
  • Portability — receive your data in a structured, machine-readable format

To exercise any of these rights, contact us at the address below. We will respond within 30 days. You also have the right to lodge a complaint with the Office of the Data Protection Commissioner of Kenya if you believe your rights have been violated.

9. Data Security

We implement reasonable technical and organisational measures to protect your personal data against accidental loss, unauthorised access, disclosure, or destruction. These measures include access-controlled admin systems, encrypted data transmission (HTTPS), and use of industry-standard cloud infrastructure with its own security certifications.

No method of transmission over the internet is 100% secure. While we take data protection seriously, we cannot guarantee absolute security.
